2.2.3 Processing basis

Molo processes your personal data on the basis below. The basis depends on the nature of your inquiry.

Legitimate interests: We can process your personal data on the basis of our legitimate interests in handling your inquiry, communicating with you and developing our products and services (data protection regulation article 6, paragraph 1, letter f).
Contractual obligations: If your inquiry concerns a (potential) conclusion of an agreement, We process your information in order to implement measures prior to the conclusion of the agreement (data protection regulation article 6, paragraph 1, letter b).

The retention period depends on the nature of the inquiry. General inquiries are stored in op to 2 years. If you are a customer or are employed by one of our customers, suppliers, business customers and others external partners etc., we refer to the section below.

When you contact Molo or otherwise communicate with us, we may share your personal data processors who supply IT systems to support communication, including e.g mail providers. Our data processors process your personal data on behalf of Molo and exclusively in compliance with documented instructions issued by Molo. Data processors only have access to the information necessary to carry out their specific, defined tasks.

2.3 If you use our webshop

2.3.1 Types of personal data

When you use our webshop, Molo processes your personal data. Molo can collect, process and store the following types of personal data about you:

Your name
Your email address
Your phone number
Your address
Your payment information
Information about your order/purchase history
Digital footprints (e.g. information on how to use Molo's webshop)

2.3.2 The purposes of the processing

Your personal data is processed for the following purposes:

Execution of orders in Molo's webshop
Administration of shipments, complaints and returns
Sending marketing without consent based on previous purchases from us in cases where where we choose to make use of this option in the Marketing Act
Statistics and analysis

2.3.3 Processing basis

Molo processes your personal data on the following basis:

Legitimate interests: We process your personal data on the basis of our legitimate interests in marketing us to you in cases where consent is not required, as well as our legitimate interest in being able to conduct statistics and analysis with a view to developing and improve our services (data protection regulation art. 6, paragraph 1, letter f).
Contractual obligations: We process your personal data to fulfill the contract purchase agreement with you, including to be able to deliver the ordered goods, handle complaints, returns, etc. (Data Protection Regulation Article 6, paragraph 1, letter b).

2.3.4 Retention period

As a general rule, we will store your personal data for 2 years after your last purchase. If you have purchased products that are covered by a guarantee, we delete your personal data at the end of warranty period. Information relating to accounting material is stored for 5 years from the end of the accounting year, to which the information relates. We may, however, process your personal data for a longer period i anonymized form.

2.3.5 Categories of recipients

When you use our webshop, we can share your personal data with the following categories recipients:

Data processors who supply IT systems for handling orders, including administration of shipping options and user administration as well as communication, including e.g. mail provider.
Data processors who provide IT systems to support marketing, statistics and analysis.

Molo collects, processes and stores your personal data for marketing purposes when you sign up for newsletter(s). Molo can collect, process and store the following types of personal data about you:

Name and email address
Your consent
Your clicking behavior in relation to posted material

Your personal data may be processed for the following purposes:

Marketing
Analysis and statistics

2.4.3 Processing basis

Molo processes your personal data on one or more of the following bases:

Consent: Molo will only use your personal data for direct marketing, including sending out newsletters if you have given your prior and express consent to this (data protection regulation article 6, paragraph 1, letter a).
Legitimate interests: The processing of your personal data in connection with analysis and statistics we base it on our legitimate interests in being able to improve and develop our services (data protection regulation article 6, paragraph 1, letter f).

2.4.4 Retention period

Your personal data will be stored as long as your consent to receive marketing is active. If you no longer wish to receive our newsletters, you can unsubscribe via the link at the bottom of each email or by contacting us as described below. Withdrawal of your consent does not, however, affect the legality of the processing that preceded the revocation. We store documentation for your consent for two years from the time you have revoked your consent to receive direct marketing material. The retention period is determined on the basis of our legitimate interest in being able to document that we have sent out direct marketing in accordance with applicable legislation (data protection regulation article 6, paragraph 1, letter f).

When you sign up for our newsletter, we may share your personal data with data processors who supplies IT systems to support marketing and communication, including e.g mail providers. 3. If you are looking for a job at Molo

When you apply for a job at Molo, we process your personal data in connection with the recruitment process. We recommend that your application does not contain a CPR number or sensitive information personal data, such as personal data revealing racial or ethnic background, religion, trade union membership, sexuality or health information.

3.1 Types of personal data

Molo can collect, process and store the following types of personal data about you:

Contact information such as name, e-mail address and telephone number
Information that appears in the application, CV and any attachments
Relevant information that is publicly available on the internet and social media, Including particular information about previous employment, activities, competences, performance and general appearance
Results of personality tests, if you complete such
Criminal record, if necessary in relation to the position you have applied for
References from previous and/or current employers that you have indicated in your application, or that you have given consent for us to contact
Health information, if the position you have applied for makes special health requirements
Other information you give us in connection with the recruitment process

3.2 Purpose of the processing

Your personal data will be used to assess whether we want to offer you a position at Molo.

3.3 Processing basis

Molo processes your personal data on one or more of the following bases:

Legitimate interests: We can process your personal data on the basis of our legitimate interests interest in assessing whether we want to offer you employment, including on the basis of the information you provide in your CV, application and any attachments, based on relevant information that are publicly available on the internet and social media, results of personality tests, references from reference persons you have specified in your application and other information you gives us in connection with the recruitment process. The treatment may also be necessary for our legitimate interest in defending or asserting legal claims (data protection regulation article 6, paragraph 1, letter f).
Consent: If we cannot offer you a job, in some cases we would like to be allowed to save your application for a later time. We only do this if you have given yours prior consent to this (data protection regulation article 6, paragraph 1, letter a). In special cases, the position you have applied for may require health conditions, which we out from a specific assessment need to know before we can offer you the position. In these cases will we obtain your express consent prior to the processing of your sensitive data personal data (data protection regulation article 6, paragraph 1, letter a and article 9, paragraph 2, letter a).

3.4 Retention period

If you are offered a position at Molo, your application and additional relevant personal data collected in connection with the employment procedure will be stored in your personnel file with us. If you are not offered a position, we will store your application and any additional ones personal data collected in connection with the employment procedure, for a period of 6months after our refusal, unless you have given your consent to a longer storage of such personal data.

You can revoke any consents you may have given as part of our at any time employment procedure. Withdrawal of your consent will have effect for the future processing of your personal data, but does not affect the legality of the processing that is based on the consent prior to the revocation. If you wish to withdraw your consent, you can contact us as indicated below.

The criminal record is deleted immediately after we have reviewed it.

When you apply for a job at Molo, we may share your personal data with data processors who deliver IT systems to support HR solutions that support recruitment and communication, including e.g. mail providers.

Our data processors process your personal data on behalf of Molo and exclusively in compliance with documented instructions issued by Molo. Data processors have only access to the information necessary to carry out their specific, defined tasks.

4. If you are a supplier, business customer, or other external business partner, etc.

This section contains the policy for Molo's processing of personal data about owners of sole proprietorships or contact persons at suppliers, business customers and others external business partners etc. who collaborate with Molo.

4.1 Collection of personal data

Molo can collect, process and store your personal data in the following cases:

When your company or the company you work for enters into an agreement with Molo
When you collaborate and communicate with Molo

4.2 Types of personal data

Molo can collect, process and store the following types of personal data about you:

Name, e-mail address, telephone number and corresponding contact information
Individual information, eg preferred language
Organizational information such as company name and address, job title, area of employment, primarily workplace and country
Contractual information such as orders, invoices, contracts and other agreements between your company (or your employer) and Molo, which may contain e.g. your contact details

Molo primarily processes your personal data on one or more of the following bases:

Contractual obligations: In certain cases, the processing of your personal data is necessary in order to be able to fulfill a contract (data protection regulation article 6, paragraph 1, letter b).
Legitimate interests: We can process your personal data on the basis of our legitimate interests interests in, for example, managing day-to-day operations in accordance with legal and fair business methods, including planning, execution and administration of the collaboration or our legitimate interest in e.g. performing credit assessments, statistics, analyzes and providing support. The processing may also be necessary for our legitimate interest in preventing fraud or determine, defend or assert legal claims (data protection regulation article 6, paragraph 1, letter f).
Legal obligation: The processing of your personal data will in some cases be necessary for compliance with legal obligations, such as our obligation to prevent illegal activities (data protection regulation article 6, paragraph 1, letter c).

Your personal data will be stored for 2 years after the end of the collaboration. Information relating to accounting material is stored for 5 years from the end of the financial year in which the information relates to.However, the information can be stored longer in anonymized form.

4.6 Categories of recipients

We may share your personal data with the following categories of data processors:

Data processors who provide IT systems to support the administration of contract and working relationship and communication, including e.g. mail provider.
Data processors who provide support for marketing and statistics, including analysis.
Third parties, including suppliers of the selected payment service that receives your payment information, for use to verify and complete your payment (cf. of the data protection regulation, Article 6, subsection 1, letter f).
Third parties, including suppliers of the selected freight service (cf. of the data protection regulation, Article 6, subsection 1, letter b).

5. If you are a model for Molo or the parent/guardian of a model at Molo

When you are a model for Molo or a parent/guardian of a model for us, we process yours personal data in connection with the working relationship.

5.1 Types of personal data

Molo can collect, process and store the following types of personal data about you:

Contact information such as name, e-mail address and telephone number
Pictures
Body measurements, including waist measurement, height, shoe size, etc.
Health information, if the position you hold makes special demands on health conditions
Other information you give us in connection with the working relationship

We can receive such information directly from you (primarily through e-mails and other correspondence with you) or from a third party such as your modeling agency.

5.2 Purpose of the processing

Your personal data may be processed for the following purposes:

General planning, fulfillment and administration of collaborations, including contracts
Administration such as processing of payments, evaluation of credit ratings, accounting and auditing
General communication
Development and production of our products
Compliance with applicable legislation and regulations, e.g. fulfilling our obligations to prevent illegal activities

5.4 Retention period

Your personal data will be stored for 2 years after the end of the collaboration. Images in connection with photoshoots are stored in accordance with the regulations on use of images in the model switch.

5.4.1 Categories of recipients

When you are a model for Molo or a parent/guardian of a model for us, we can share your personal data with data processors who deliver IT systems to support marketing, production and design and communication, including e.g. mail providers.

Our data processors process your personal data on behalf of Molo and exclusively in compliance with documented instructions issued by Molo. Data processors only have access to the information necessary to carry out their specific, defined tasks.

6. If you visit our physical locations

6.1 When you visit our stores

This section contains the policy for Molos' processing of personal data about customers in Molos shops.

6.1.1 Types of personal data

When you visit or buy something in one of Molo's stores, Molo can collect, process and store it your payment information.

6.1.2 The purposes of the processing

Your personal data may be processed for the following purposes:

Fulfillment of your purchases
So that legal claims can be established, asserted or defended

6.1.3 Processing basis

Molo processes your personal data on one or more of the following bases:

Legitimate interests: In most cases, we base the processing of your personal data on our legitimate interests in being able to establish, defend or enforce legal claims (data protection regulation article 6, paragraph 1, letter f). This applies, for example, to treatment in relation to complaints.
Legal obligation: The processing of information about your payment details and your purchases is necessary for compliance with applicable accounting legislation, VAT legislation andmarketing legislation (Article 6, subsection 1, letter c of the Data Protection Act).

6.1.4 Retention period

Information relating to accounting material is stored for 5 years from the end of the financial year in which the information relates to. We may, however, process your personal data for a longer period i anonymized form.

6.1.5 Categories of recipients

When you visit us in our stores, we may share your personal data with the following categories recipients:

Data processors who provide IT systems for the administration of checkout systems.
Third parties, including suppliers of the selected payment service that receives your payment information, for use to verify and complete your payment (cf. of the data protection regulation, Article 6, subsection 1, letter f).

7. When you deliver goods to us

7.1 Types of personal data

When you deliver goods at our physical locations, Molo processes your personal data via TV- supervision. Molo can collect, process and store the following types of personal data about you:

Your employer
Number plate
Photo and video material in connection with TV surveillance

7.2 The purposes of the processing

Your personal data is processed for the following purposes:

To give you access to our physical locations
To ensure the security of our physical locations
To prevent and solve crime at our physical locations

7.3 Processing basis

Molo processes your personal data on the following basis:

Legitimate interests: We base the processing of your personal data on our legitimate ones interests in being able to give you access to our physical locations as well as in protecting our physical locations (data protection regulation article 6, paragraph 1, letter f).

Information about criminalsconditions collected via TV surveillance are also processed on the basis of Molo's rightsinterests in solving criminal matters (section 8, subsection 3 of the Data Protection Act).

7.4 Retention period

Recordings from TV surveillance set up for crime-fighting purposes are stored for a maximum of 30 days, unless we need to store the information longer for the purpose of clarification a specific case. However, the information can be stored longer in anonymized form.

7.4.1 Categories of recipients

When you deliver goods to us, we may share your personal data with data processors who provide IT systems for TV surveillance.

8. When you visit our office facilities and other buildings

8.1 Types of personal data

When you visit our office facilities and other buildings, Molo processes your personal data via guest registration. Molo can collect, process and store the following types of personal data about you:

Your employer
Your email address
Your phone number
Date and time of your visit
Travel information, including your passport number or copy of your passport (if Molo must assist with application for a visa in connection with your visit)

Your personal data will be stored for 2 years after the end of the collaboration. However, the information can stored longer in anonymized form.

For LinkedIn, Facebook, TikTok, Instagram and Pinterest, Molo is together with the providers of those social media joint data controllers for the processing of personal data collected in connection with your interactions with the profiles, including the posts of the profiles.

Molo and the providers of LinkedIn, Facebook, TikTok, Instagram, and Pinterest have entered into an agreement on the allocation of data protection responsibilities. Under these agreements, Molo and the providers of the social media platforms are each responsible for the tasks associated with the processing that each of us carries out.

However, it has been agreed between Molo and the provider of Facebook and Instagram that the provider is responsible to enable you to exercise your rights as described in the section 'Your rights' below, in connection with the use of Facebook and Instagram, and that Molo is responsible to provide you with the information described below.

It has also been agreed between Molo and LinkedIn, that LinkedIn is responsible for responding to requests from you regarding the rights that are described in the section 'Your rights' below.

Molo also uses the provider of YouTube as a data processor in connection with these devices' use of YouTube and in that connection also share certain information about your interactions, interests etc. with YouTube. This sharing takes place on the basis of our and Google's legitimate interest in optimizing marketing and the service, including our videos, on YouTube (data protection regulation article 6, paragraph 1, letter f).

9.1 Collection of personal data

When you visit or interact with our profiles on social media, Molo and the provider of it can the social media in question collect, process and store the following types of personal data about you:

Information available on your profile, including your name, gender, marital status, workplace, interests, image and your city
Whether you "like" or have used other reactions to our profile
Comments you leave on our posts
That you have visited our profile
Your IP address

9.2 The purposes of the processing

Molo processes your personal data for the following purposes:

Improving our products and services, including our profiles and pages on social media
Statistics and analysis
To be able to communicate with you, if you comment on a post, make a report or send us a message
Marketing in general

The providers of the social media process, among other things, your personal data for the following purposes:

Improving their advertising system
To provide Molo with statistics that the providers of the social media, among other things, compile on basis of your visit to our profiles and pages
Advertising and adaptation of the activities on the site.

9.3 Processing basis

The processing of your personal data is based on the following basis:

Legitimate interests: Molo bases the processing of your personal data on our legitimate ones interests in being able to communicate with and market ourselves to you on our profiles at social media, as well as our legitimate interest in improving our products and services (data protection regulation article 6, paragraph 1, letter f)

9.4 Retention period

Direct inquiries are stored as a starting point for up to 2 years, but the storage period is depending on the content of the inquiry. We encourage you to delete comments, likes and other interactions you have left on our profile, if you no longer want them displayed on our pages. Molo does not delete such publicly available ones interactions.

Please see the privacy policy of the individual social media provider for information on where as long as they store your personal data.

9.5 Categories of Recipients

When you visit our profiles on our social media, we may share your information data processors who provide IT systems to support marketing, including providers of the social media (see the list above) where we can market our activities.

9.6 Who do social media providers share your personal data with?

The providers of social media can, among other things, share your personal data with the following categories of recipients:

Other entities in the group the provider of the social media is part of
External partners who provide analysis and investigation services
Advertisers
Other individuals who visit our profile or page on the social media (to the extent your information is publicly available)
Researchers and other academics

The providers of the social media can transfer your personal data to recipients outside the EU/EEA in accordance with applicable data protection legislation. You can read more in the individual pages providers' privacy policies.

10. Disclosure to other data controllers

Under each section above, you can read about which categories of recipients we can share your personal data with. The following applies in addition to the recipients we have specified for eachsection above.

Changes in the company structure: In connection with Molo's development, the company structure may change, e.g. by full or partial sale of the company. In the event of a partial transfer of assets containing personal data, is the processing basis for the connected transfer of personal data as a starting point of the data protection regulation, Article 6, subsection 1, letter f, as Molo has an interest in transferring parts of its assets as well as making commercial/structural changes.

Disclosure: Apart from what is described above, your personal data will not be passed on as a rule to a third party without your permission. However, it can under certain circumstances and according to legislation, it may be necessary to pass on your personal data to e.g. the police, lawyers, auditors, courts, other public authorities, potential buyers and group affiliates companies.

If your personal data is transferred to data processors or data controllers established in countries outside the EU/EEA that do not have an adequate level of protection will such a transfer only happen when a transfer basis has been secured. Furthermore, the transfer will be based on EU Commission's standard contracts and/or the EU-US Data Privacy Framework.
